1. Agreement Overview
This Terms of Service ("TOS") and Acceptable Use Policy ("AUP") constitute a legally binding agreement between Aminserve Technologies ("Aminserve", "We", "Us", or "Our") and any individual, entity, or organization ("Customer", "You", or "Your") purchasing or utilizing Aminserve compute, remote desktop, proxy, VPN, or dedicated infrastructure.
Aminserve delivers bare-metal, unmanaged virtual private servers, dedicated hardware, static proxies, and encrypted tunnels. Customers retain sole administrative control over their virtual machines, instances, and configurations, and bear full, unmitigated legal responsibility for all traffic, content, and processes executed on their assigned resources.
By creating an account, completing an invoice, or launching an instance, you confirm that you have read, understood, and agreed to adhere to these terms in their entirety. Continued use of our infrastructure following any published revisions constitutes affirmative acceptance.
2. Prohibited Activities & Abuse Standards
Aminserve maintains an uncompromising zero-tolerance policy against malicious or unlawful exploitation of our network backbones. Customers must strictly refrain from using our servers, proxies, or VPN tunnels for any of the following activities:
- Cybercrime & Intrusion: Unauthorized vulnerability probing, port scanning, brute-force dictionary attacks, exploit deployment, credential stuffing, phishing, or financial data interception.
- Distributed Denial of Service (DDoS): Originating or relaying UDP floods, SYN floods, amplification attacks, or participating in booters, stressers, or botnet command-and-control operations.
- Malware & Ransomware Distribution: Hosting, transmitting, or compiling malicious binaries, trojans, rootkits, keyloggers, or command-and-control nodes.
- Spam & Bulk Transmission: Originating unsolicited commercial emails (UCE), automated mass-mailing scripts, SMS blasting, or harboring spam redirector sites that trigger IP blacklisting (Spamhaus, SURBL, Barracuda).
- Exploitation & Extremist Material: Hosting or relaying child sexual abuse material (CSAM), non-consensual imagery, terrorist propaganda, or violent extremist publications. Immediate termination and reporting applies.
- Fraudulent Schemes: Hosting high-yield investment programs (HYIP), Ponzi schemes, fake e-commerce gateways, deceptive banking mimics, or identity theft repositories.
- Copyright & Trademark Infringement: Operating public torrent trackers for copyrighted media or hosting pirated software repositories in violation of international intellectual property treaties.
If an assigned IP address is blacklisted or subjected to upstream carrier abuse notices due to customer negligence or illicit activity, Aminserve reserves the right to immediately terminate the service. A remediation fee of up to $50 per clean IP replacement will be assessed to restore administrative access with a fresh operating system.
3. Infrastructure Usage & Fair Performance
To safeguard shared host node stability and prevent neighbor interference on virtualized infrastructure (KVM VPS and Windows RDP):
- Host Node Isolation: Customers may not attempt hypervisor breakouts, kernel tampering, or unauthorized host bridge access.
- CPU & I/O Fairness: While dedicated servers provide 100% exclusive bare-metal allocation, VPS and RDP services must not run continuous 100% synthetic CPU crypto-mining loops or I/O thrashing scripts without prior authorization.
- Proxy & VPN Concurrency: VPN subscriptions permit up to 10 concurrent active tunnels per active account. Dedicated and Static proxies carry unmetered gigabit bandwidth on dedicated ports, while Rotating Residential traffic is billed strictly against prepaid gigabyte allocations.
4. Provisioning, Delivery & Service Levels
Aminserve relies on automated orchestration pipelines integrated directly into our WHMCS billing gateway:
- Instant Delivery: Standard KVM VPS, Windows Admin RDP, High-Speed VPN credentials, and Static/Rotating Proxies are provisioned automatically within seconds upon confirmed invoice payment.
- Custom & Bare-Metal Deliveries: Custom hardware builds, enterprise dedicated servers, Swiss bunker installations, and specialized routing configurations are manually assembled, burn-in tested, and delivered within 24 hours or less.
- Network Uptime: We engineer our datacenter facilities for 99.9% network and hardware power availability, excluding scheduled maintenance announced at least 24 hours in advance.
5. Legal Compliance & Law Enforcement
Aminserve operates transparently and complies with valid international legal processes.
- Customer Sovereignty: We do not actively monitor, inspect, or intercept customer network payloads or file contents. We provide raw compute and routing pipelines.
- Valid Judicial Orders: We cooperate strictly with legally binding court orders and lawful requests served by competent judicial authorities where required by applicable law.
- Abuse Inquiries: Customers must acknowledge and remediate legitimate third-party abuse reports forwarded by our network operations team within 24 hours. Failure to respond will result in automated port containment.
6. Account Suspensions & Service Termination
Aminserve reserves the explicit right to suspend, throttle, or permanently decommission services under the following circumstances:
- Detection of prohibited activities as outlined in Section 2.
- Non-payment of renewal invoices past the due date grace period.
- Chargebacks, payment disputes, or fraudulent credit card transactions (resulting in immediate cross-account termination).
- Failure to address severe upstream network abuse complaints.
Accounts terminated due to malicious conduct or deliberate AUP violations will be permanently banned from the Aminserve platform.
7. Payments, Invoicing & Strict Refund Policy
7.1 Billing & Renewals
All recurring services (VPS, RDP, VPN, Proxies, Dedicated Servers) are billed in advance on monthly, semi-annual, annual, biennial, or triennial billing cycles. Invoices are generated 7 days prior to renewal. Services not renewed by their expiration timestamp enter automated suspension.
7.2 No-Refund Policy
Due to the immediate provisioning of dedicated computational resources, unmetered network uplinks, upstream bandwidth commitments, and clean IP address allocations:
- Dedicated Servers, Custom Bare-Metal, and Domain Registrations are strictly non-refundable under all circumstances.
- Virtual Private Servers (VPS), Windows RDP, Proxies, and VPN services are non-refundable once deployed and active.
- In exceptional circumstances involving unresolved hardware failure on our side, refund or account credit requests may be reviewed on a discretionary, case-by-case basis through a formal ticket submission.
- Initiating an external dispute or chargeback with your payment provider immediately voids all services and results in account suspension.
8. Backups, Data Integrity & Retention
Aminserve delivers unmanaged infrastructure. Customers bear ultimate responsibility for maintaining offsite, encrypted backups of their critical data, codebases, and databases.
Customers can add automated weekly and monthly offsite backup storage to both VPS and RDP services during order checkout or via the client portal. Backups are stored in an independent secondary facility.
In the event of service cancellation or termination due to non-payment, customer virtual machines and local disks are queued for automated cryptographic zeroization within 30 days. Aminserve cannot retrieve data from purged instances.
9. Service Disclaimers & Limitation of Liability
AMINSERVE SERVICES ARE PROVIDED STRICTLY "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR UNINTERRUPTED AVAILABILITY.
UNDER NO CIRCUMSTANCES SHALL AMINSERVE TECHNOLOGIES, ITS DIRECTORS, OFFICERS, EMPLOYEES, OR UPSTREAM INFRASTRUCTURE PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA CORRUPTION, BUSINESS INTERRUPTION, OR REPUTATIONAL HARM ARISING OUT OF THE USE OR INABILITY TO USE OUR SERVICES.
10. Dispute Resolution & Governing Law
Any dispute, controversy, or claim arising out of or relating to this agreement shall be settled through confidential, binding commercial arbitration in accordance with internationally recognized arbitration rules.
Each party shall bear its own legal expenses and share equally in the administrative costs of arbitration. If any individual clause of this agreement is deemed invalid or unenforceable by a tribunal of competent jurisdiction, the remaining clauses shall remain in full force and effect.
